1 · AGE — 21 AND OVER ONLY

You must be at least 21 years old to browse, order, or receive our products. We verify age at checkout and require an adult signature on delivery. We do not sell to anyone under 21 under any circumstance, and we will cancel any order we believe is being placed for a minor.

Providing false information about your age is a breach of these terms and voids any refund, replacement, or warranty obligation we would otherwise have.

2 · WHAT WE SELL

Our products are hemp-derived and produced to comply with the federal standard in effect at the time of sale. Cannabinoid content is stated on the product page and on the package. Natural agricultural variation means batch-to-batch results differ; stated percentages are the tested value for that batch, not a guarantee of effect.

Federal standard change — November 12, 2026

Section 781 of Public Law 119-37 changes the federal definition of hemp to a total-THC standard and caps finished consumable products at 0.4 mg total THC per retail container, effective November 12, 2026. Products ordered before that date are sold under the standard in effect on the order date. We may discontinue, reformulate, or restrict any product at any time to remain compliant, without liability to you beyond a refund of amounts paid for undelivered goods.

3 · YOUR RESPONSIBILITY FOR LOCAL LAW

Hemp law differs by state, county, and city, and changes frequently. We maintain a Shipping Policy listing where we will and will not ship, and we block prohibited destinations at checkout before payment. That blocking is a good-faith effort, not a legal opinion about your address.

By ordering, you represent that the products in your cart are lawful for you to purchase, possess, and receive at your delivery address. You agree not to use a forwarding address, mail drop, or third-party address to circumvent a restriction, and you accept sole responsibility for any consequence of doing so. We reserve the right to cancel and refund any order we believe would be unlawful to fill, at our sole discretion, without explanation.

4 · ASSUMPTION OF RISK AND DRUG TESTING

THESE PRODUCTS ARE INTOXICATING AND WILL LIKELY CAUSE YOU TO FAIL A DRUG TEST. Standard employment and legal drug screens detect THC metabolites and do not distinguish hemp-derived cannabinoids from marijuana. If you are subject to testing for any reason — employment, probation, athletics, military service, custody, professional licensing — do not order.

Do not drive, operate machinery, or perform any safety-sensitive task after use. Effects can be delayed with edibles; start low. Keep out of reach of children and pets. Do not use if pregnant or nursing. Consult a physician before use if you take prescription medication or have a medical condition.

You assume all risk arising from your use of these products, including impairment, adverse reaction, employment consequences, and legal consequences in your jurisdiction.

5 · NO MEDICAL OR HEALTH CLAIMS

We make no claim that any product diagnoses, treats, cures, mitigates, or prevents any disease or condition. Statements on this site have not been evaluated by the Food and Drug Administration. Nothing here is medical advice.

Customer reviews are the opinions of the people who wrote them and are not endorsed by us. We publish reviews as received, we do not pay for or incentivize reviews, and we do not remove reviews for being negative. We may withhold a review that makes a medical claim, identifies a third party, or contains unlawful content.

6 · ORDERS, PRICING, AND CANCELLATION

An order is an offer to buy. Our acceptance occurs when we ship. We may refuse or limit any order, including for suspected resale in a prohibited state, suspected fraud, or age concerns. Prices, promotions, and availability may change without notice; obvious pricing errors are not binding on us.

You may cancel before dispatch by calling 1-888-823-2759. Once a package is in the carrier's possession, cancellation is not possible.

7 · RETURNS AND REFUNDS

Consumable products cannot be returned once opened. This is a safety and tamper-evidence requirement, not a preference. Unopened products in original packaging may be returned within 30 days of delivery for a refund of the purchase price; outbound shipping is not refunded.

Damaged or incorrect items: contact us within 7 days of delivery with photographs and we will replace or refund. Orders to a prohibited state are cancelled and refunded in full, including shipping. Packages seized or refused in transit are refunded; we cannot reship into a state that rejected the shipment.

Effect is not a defect. We do not refund because a product was stronger, weaker, or different from what you expected.

8 · PAYMENT AND DISPUTES

Card payments are processed through Authorize.net. Card data is tokenized in your browser and is never stored on our systems. We retain, for each order, the authorization result, AVS and CVV match results, delivery confirmation and signature, and the record of the agreements you accepted at checkout.

If you dispute a charge for an order you placed and received, you authorize us to submit that record to your card issuer as evidence. Filing a chargeback instead of contacting us first is a breach of these terms; we may refuse future orders and recover our costs of responding.

9 · BINDING ARBITRATION AND CLASS-ACTION WAIVER

PLEASE READ — THIS SECTION AFFECTS YOUR LEGAL RIGHTS.

Any dispute arising out of or relating to these terms, our products, or your purchase will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Lackawanna County, Pennsylvania, or conducted remotely at the arbitrator's discretion. The Federal Arbitration Act governs.

You and we each waive the right to a jury trial and the right to participate in a class, collective, consolidated, or representative action. The arbitrator may not consolidate claims or preside over any form of class proceeding. If this waiver is held unenforceable as to a particular claim, that claim proceeds in court and the remainder stays in arbitration.

Either party may bring an individual claim in small-claims court instead. You may reject this arbitration agreement by writing to TheBear@BearlyLegalHemp.com within 30 days of your first order, stating your name, order number, and intent to opt out; opting out does not affect any other term.

Before filing anything, you agree to contact us and allow 30 days to resolve the matter informally.

10 · LIMITATION OF LIABILITY AND WARRANTY

Products are sold as-is to the fullest extent permitted by law. We disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost wages, lost profits, or employment consequences.

Our total liability for any claim is limited to the amount you paid for the product at issue. Some jurisdictions do not permit these limits, in which case they apply to the maximum extent allowed.

You agree to indemnify us against claims arising from your misuse of a product, your resale or distribution of a product, or your misrepresentation of your age or the legality of delivery to your address.

11 · GOVERNING LAW

These terms are governed by the laws of the Commonwealth of Pennsylvania, excluding its conflict-of-laws rules. Any matter not subject to arbitration is subject to the exclusive jurisdiction of the state and federal courts located in Lackawanna County, Pennsylvania.

12 · MARKETING CONSENT — EMAIL AND SMS

Subscribing is optional and is never a condition of purchase. Email subscribers confirm by clicking a link in a confirmation message. If you provide a mobile number and opt in, you consent to receive recurring automated marketing texts at that number; message and data rates may apply. Reply STOP to cancel, HELP for help. Consent records — the number, the date, the language shown, and the source — are retained.

13 · PRIVACY AND YOUR DATA

We collect what an order requires: contact and delivery details, order history, age-verification result, consent records, device and IP data, and payment authorization results (never full card numbers). We use it to fulfil orders, prevent fraud, meet legal obligations, and — with consent — market to you. We do not sell personal information.

Residents of California and other states with comparable laws may request access to, correction of, or deletion of their personal information, and may opt out of targeted advertising, by emailing TheBear@BearlyLegalHemp.com. We will verify your identity before acting. We retain order, age-verification, and consent records for as long as required to defend claims and satisfy regulators, which may mean retaining them after an account is deleted.

15 · CHANGES TO THESE TERMS

We may update these terms. The version in effect when you place an order is the version that governs that order, and the version number is recorded with it. Material changes are posted here with a new effective date. Continued ordering after a change means you accept the current version.
