HEMP THC AND DRIVING

Don't drive on the day you've used it. That's the only advice we'll give with a straight face.

"It's legal to buy" has never meant "it's legal to drive on." Those are different bodies of law and only one of them cares where your THC came from.

We get asked for a number — how many hours. There isn't one we can honestly give, and this page explains why the question doesn't have the answer people want.

Impaired-driving statutes are written around any intoxicating substance. They don't distinguish prescription medication, alcohol, marijuana or hemp-derived THC. If you're impaired, the fact that the product was lawfully bought is not a defence — it's not even a relevant fact.

And hemp-derived THC impairs exactly like any other THC, because it is the same molecule reaching the same receptors. THCA converts to delta-9 when you light it. Delta-8 is milder at the same dose but not non-impairing. Your reaction time, lane control and judgement of distance are affected regardless of the plant's legal classification.

Per se limits and zero tolerance

Two broad models, and which one your state uses changes the risk substantially.

Zero toleranceAny detectable THC or metabolite while driving. A handful of states, and some apply it only to drivers under 21 or with commercial licences.

Zero tolerance is the one to understand. Under it, the question isn't whether you were affected — it's whether a test found anything. Metabolites can persist well beyond any subjective effect, so a driver who feels completely normal can still be over a zero-tolerance line.

Rules change and vary by licence class. Check your own state's current statute rather than trusting a summary — including this one.

What a roadside test actually detects

Oral-fluid devices at the roadside, blood at the station. Both detect THC and its metabolites. Neither identifies the source.

Which means the same thing here as it does for workplace drug tests: your receipt, your COA and the words "hemp-derived" on the pouch change nothing about the result. A lab can tell you there's THC in the sample. It cannot tell you the plant was federally compliant, and no prosecutor is required to care.

Some drivers do carry the packaging and the lab report. It's not nothing — it may help explain the situation — but it is not a defence and shouldn't be treated as insurance.

Why we won't give you an hours number

Because the honest answer is that nobody can give you one that holds up.

  • Subjective effects and blood THC don't track together. Feeling fine is not evidence of being under a threshold, particularly for a per se or zero-tolerance rule.
  • Frequency changes everything. Regular users carry measurable THC for far longer than occasional ones, because it's stored in fat and released slowly.
  • Dose and format matter. An edible's effects last six to eight hours, sometimes longer at a high dose — several times the window of a couple of puffs.
  • Bodies differ. Body composition, metabolism, hydration, what you ate.

So the practical rule we actually use: if you've used it today, you're not driving today. Boring, unhelpful for someone trying to plan an evening, and the only version that doesn't involve us guessing with your licence.

What to do instead

  • Decide before, not after. Impaired judgement about your own impairment is the classic failure. Sort the ride home while you're sober.
  • Treat edibles as an evening commitment. Six to eight hours means a gummy at 8 pm can still be with you at 3 am.
  • Don't drive the morning after a large dose. Especially edibles, especially if you woke up foggy.
  • Transport it unopened, in the boot. An open product in the cabin invites a whole separate conversation.
  • Never combine with alcohol and drive. The combination impairs more than either alone and is treated accordingly.
